Acceptance of These Terms

Welcome to DaycareHubBC.

These Terms of Use (“Terms”) govern your access to and use of the DaycareHubBC website, platform, and related services (“DaycareHubBC,” the “Platform,” or the “Services”).

By creating an account or using DaycareHubBC, you agree to these Terms.

If you do not agree to these Terms, you should not create an account or use the Services.

Some features may also be subject to additional terms presented to you when you use or purchase those features. If additional terms apply, they form part of your agreement with DaycareHubBC.

Eligibility and Minimum Age

You must be at least 18 years old to create or manage a DaycareHubBC account.

DaycareHubBC is not intended for children to create or manage accounts.

Parents or legal guardians may provide information about their children when using childcare-related features, such as daycare waitlists or other services, in accordance with our Privacy Policy.

By creating an account, you confirm that you are legally able to enter into these Terms.

About DaycareHubBC

DaycareHubBC is an online marketplace designed to help families connect with childcare providers, primarily in the Tri-Cities area of British Columbia, including Coquitlam, Port Coquitlam, and Port Moody.

Features may include:

  • daycare search and discovery
  • daycare profiles and listings
  • waitlist applications
  • childcare spot offers and responses
  • daycare tour bookings
  • reviews
  • job postings and applications for ECE teachers and other childcare professionals
  • provider account and waitlist management tools
  • notifications and related communication tools
  • other childcare-related services that we may introduce from time to time

DaycareHubBC provides technology and tools that help users connect and communicate. Unless we expressly state otherwise, DaycareHubBC is not itself a daycare operator or childcare provider.

Free Services for Parents

DaycareHubBC is currently free for parents and families to use for standard parent features.

This may include creating an account, searching for daycares, joining waitlists, booking tours, responding to childcare spot offers, and leaving reviews where eligible.

If we introduce a paid parent feature in the future, applicable pricing and terms will be clearly disclosed before a user is charged.

Provider Subscriptions and Payments

Daycare providers may be required to purchase a paid subscription to access certain provider features.

Available plans, prices, billing periods, included features, and applicable cancellation terms will be displayed when a provider selects or purchases a subscription.

Payments are processed through our third-party payment processor, Stripe.

Subscription Billing

Subscriptions automatically renew at the end of each billing period at the price and interval shown at checkout, and continue until cancelled.

Providers are responsible for maintaining accurate billing information and paying applicable subscription charges when due.

Changes to Subscription Plans

We may change subscription plans, features, or prices from time to time.

Where a change affects an existing paid subscription, we will provide notice where reasonably appropriate or where required by applicable law.

Cancellation

Providers may cancel a subscription using the cancellation methods made available through DaycareHubBC.

Unless otherwise stated when the subscription is purchased, cancellation generally stops future renewal and does not automatically entitle the provider to a refund for a billing period that has already begun.

Any refund rights required by applicable law are not affected by these Terms.

Refund Policy

Except where required by applicable law, subscription fees already paid to DaycareHubBC are generally non-refundable.

Cancelling a subscription stops future renewal in accordance with the applicable cancellation terms but does not normally result in a refund or prorated credit for a billing period that has already begun.

We may issue a full or partial refund where appropriate, including in cases of:

  • duplicate charges;
  • incorrect charges caused by a billing or technical error;
  • charges made after a subscription should have been cancelled or billing should have been paused; or
  • other exceptional circumstances that DaycareHubBC determines warrant a refund.

Refunds that are not required by law are provided at DaycareHubBC's discretion.

Nothing in this Refund Policy limits any refund, cancellation, or other rights that cannot lawfully be excluded under applicable law.

Failed Payments

If a required subscription payment fails or remains unpaid, we may limit access to paid provider features until the payment issue is resolved.

User Accounts

You are responsible for providing accurate and truthful information when creating and using your account.

You are responsible for keeping your login credentials confidential and for taking reasonable steps to protect your account.

You must promptly notify DaycareHubBC if you believe that:

  • your account has been accessed without authorization;
  • your password or login credentials have been compromised; or
  • someone is improperly using your account.

You may not impersonate another person or organization or create an account using information that you are not authorized to use.

User Responsibilities

When using DaycareHubBC, you agree to:

  • provide information that is accurate and truthful to the best of your knowledge;
  • keep important account and profile information reasonably up to date;
  • treat other users respectfully;
  • attend scheduled daycare tours or cancel with reasonable notice when possible;
  • submit reviews based on genuine experiences;
  • use information obtained through DaycareHubBC only for legitimate purposes related to the Services; and
  • comply with applicable laws and these Terms.

Prohibited Conduct

You must not use DaycareHubBC to:

  • engage in unlawful, fraudulent, deceptive, threatening, abusive, discriminatory, or harassing conduct;
  • impersonate another person, daycare, business, or organization;
  • knowingly provide materially false or misleading information;
  • create fake accounts;
  • submit fake reviews or reviews that are not based on a genuine experience;
  • manipulate ratings, recommendations, reviews, waitlists, applications, or other Platform features;
  • post spam or unauthorized advertising;
  • upload or distribute unlawful, harmful, malicious, or infringing content;
  • collect, use, or disclose another person's personal information without appropriate authority;
  • misuse information about children or families obtained through the Platform;
  • attempt to gain unauthorized access to another account, database, system, or restricted area of DaycareHubBC;
  • interfere with the security, integrity, availability, or proper operation of the Platform;
  • introduce viruses, malicious code, or other harmful technology;
  • bypass or attempt to bypass security, authentication, rate limits, access controls, or anti-abuse measures;
  • scrape, crawl, extract, copy, or access Platform data using automated means except where expressly authorized by DaycareHubBC; or
  • assist another person in doing any of the above.

Daycare Listings and Marketplace Role

DaycareHubBC helps families discover and connect with childcare providers.

Daycare providers are independent businesses or individuals and are not employees, agents, partners, or representatives of DaycareHubBC merely because they use the Platform.

DaycareHubBC does not control the day-to-day operation of independent daycare providers.

Unless expressly stated otherwise, inclusion of a daycare on DaycareHubBC does not mean that DaycareHubBC guarantees or certifies:

  • the quality of childcare;
  • the safety of a facility;
  • the accuracy of every statement in a provider's profile;
  • ongoing regulatory or licensing compliance;
  • availability of childcare spaces; or
  • suitability of a particular daycare for a particular child or family.

Where DaycareHubBC displays a verification, approval, or similar indicator, that indicator means only what DaycareHubBC specifically states it has verified or reviewed. It should not be understood as a guarantee of overall quality, safety, or future compliance.

Providers are responsible for ensuring that information they publish through DaycareHubBC is accurate and not misleading.

Parent and Guardian Responsibility

Parents and guardians are responsible for deciding whether a daycare provider is appropriate for their child and family.

Users should independently verify information that is important to their childcare decision, which may include:

  • licensing status;
  • location and facilities;
  • programs and policies;
  • staff qualifications where relevant;
  • fees;
  • availability;
  • health and safety practices; and
  • other matters important to the family.

DaycareHubBC may provide information and tools to assist with this process, but the final childcare decision remains with the parent or guardian and the childcare provider.

No Guarantee of Daycare Placement

DaycareHubBC does not guarantee that a family will receive a childcare space.

Waitlist position, availability, admission criteria, enrollment decisions, and final childcare arrangements are generally determined by individual daycare providers.

Joining a waitlist, booking a tour, receiving a notification, or otherwise interacting with a daycare through DaycareHubBC does not create a guarantee of enrollment unless the daycare and family separately complete the necessary enrollment process.

DaycareHubBC facilitates the connection but does not control a daycare's final admission decision.

Teacher and Employment Features

DaycareHubBC may allow childcare providers to post employment opportunities and teachers or other childcare professionals to apply for jobs.

Unless expressly stated otherwise, DaycareHubBC is not the employer of users who find employment through the Platform and does not guarantee:

  • employment;
  • applicant qualifications;
  • job availability;
  • compensation;
  • working conditions; or
  • the accuracy of information supplied by an employer or applicant.

Employers and applicants are responsible for conducting their own hiring, reference, credential, eligibility, and other appropriate checks.

Reviews

DaycareHubBC may allow eligible users to submit reviews about daycare providers. Reviews should:

  • reflect a genuine experience;
  • be honest and made in good faith;
  • relate to the daycare or experience being reviewed; and
  • be expressed respectfully.

Users may post negative as well as positive reviews. A review will not be removed merely because it is critical or unfavourable.

However, reviews must not contain content that we reasonably believe is:

  • knowingly false or materially misleading;
  • fraudulent or fake;
  • threatening or harassing;
  • discriminatory or hateful;
  • unlawful;
  • defamatory;
  • spam;
  • unrelated to the reviewer's genuine experience;
  • an improper disclosure of another person's private or personal information;
  • an infringement of another person's rights; or
  • otherwise in violation of these Terms or applicable content rules.

Content Moderation

DaycareHubBC may review, restrict, refuse to publish, edit for technical formatting, or remove content where we reasonably believe action is necessary to:

  • enforce these Terms;
  • respond to a valid complaint;
  • protect users;
  • protect children's or families' privacy or safety;
  • prevent fraud, abuse, or manipulation;
  • comply with legal obligations;
  • protect the rights of another person; or
  • maintain the integrity and proper operation of the Platform.

This may include reviews, daycare listings, job postings, profile information, photographs, messages, or other user-submitted content.

We do not guarantee that every piece of user content will be reviewed before publication or that inappropriate content will always be identified immediately.

We may investigate reported content and may request additional information from affected users before making a moderation decision where appropriate.

User Content and Licence

“User Content” means content that users submit, upload, publish, or otherwise provide through DaycareHubBC, including reviews, photographs, logos, daycare descriptions, profile information, job postings, and other materials.

You retain ownership of the User Content that you own.

By submitting User Content to DaycareHubBC, you grant DaycareHubBC a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, publish, and otherwise use that content as reasonably necessary to operate, provide, maintain, improve, and promote DaycareHubBC.

This licence does not transfer ownership of your User Content to DaycareHubBC.

You confirm that:

  • you own the User Content or have the necessary rights and permissions to provide it;
  • providing the content does not violate another person's rights; and
  • DaycareHubBC may use the content as described above.

Where reasonably possible, content that is no longer required after account closure may be removed or disassociated from the account in accordance with our Privacy Policy, operational requirements, and applicable law.

Intellectual Property

Except for User Content and third-party materials, DaycareHubBC and its original Platform content, software, design, branding, logos, graphics, interfaces, databases, and other materials are owned by or licensed to DaycareHubBC and are protected by applicable intellectual property laws.

Subject to these Terms, DaycareHubBC grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the Platform for its intended purposes.

You may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit DaycareHubBC or its proprietary content except where permitted by law or with our written permission.

Account Suspension and Termination

DaycareHubBC may restrict, suspend, or terminate an account, listing, or access to particular features where we reasonably believe that a user has:

  • materially violated these Terms;
  • provided fraudulent or materially misleading information;
  • engaged in harassment, abuse, discrimination, or unsafe conduct;
  • misused personal information;
  • attempted to manipulate reviews, applications, waitlists, or Platform systems;
  • failed to pay amounts properly due for a paid service;
  • created a serious security or fraud risk;
  • violated applicable law; or
  • engaged in conduct that creates a material risk to users, children, DaycareHubBC, or the integrity of the Platform.

Where reasonably appropriate, we may provide notice or an opportunity to correct the issue before suspending or terminating an account.

However, we may take immediate action where we reasonably believe it is necessary to protect users, children, personal information, Platform security, or the integrity of the Services, or where required by law.

The nature and duration of a restriction may depend on the seriousness and circumstances of the issue.

Suspension or termination does not remove payment obligations that arose before the effective date of the suspension or termination.

If DaycareHubBC suspends a provider's access for reasons other than non-payment, future subscription billing will be paused while the suspension remains in effect. We do not retroactively bill for the suspended period, and we do not refund amounts already properly charged for a period of service already provided. If an account is permanently terminated by DaycareHubBC, we will stop future subscription renewals or charges, subject to amounts already properly due and any rights or obligations required by applicable law.

Any refund following suspension or termination will be determined in accordance with the applicable subscription terms and applicable law.

Closing Your Account

You may stop using DaycareHubBC at any time.

You may also request account deletion in accordance with our Privacy Policy.

Closing an account does not automatically eliminate obligations or records that DaycareHubBC is permitted or required to retain under applicable law.

Certain provisions of these Terms that by their nature are intended to continue after account closure or termination will continue to apply, including provisions concerning intellectual property, liability, and obligations arising before termination.

Service Availability

We work to keep DaycareHubBC available and functioning reliably, but we do not guarantee that the Platform will always be available, uninterrupted, error-free, or free from technical problems.

Services may occasionally be delayed, interrupted, limited, or unavailable because of:

  • maintenance;
  • upgrades;
  • bugs or technical failures;
  • internet or network problems;
  • third-party service outages;
  • security incidents;
  • circumstances outside our reasonable control; or
  • changes necessary to maintain or improve the Platform.

We may modify, add, remove, or discontinue features from time to time.

Where a material change significantly affects an existing paid service, we will provide notice where reasonably appropriate or required by law.

Users should not rely on DaycareHubBC as the sole method of receiving urgent or time-sensitive information.

For important childcare matters, users should contact the relevant daycare or other party directly where appropriate.

Notifications and Communications

DaycareHubBC may send service-related communications, including account notices, waitlist updates, tour information, childcare spot notifications, application updates, security notices, and other communications related to use of the Platform.

Electronic notifications can sometimes be delayed, blocked, misdirected, or fail to arrive because of factors outside DaycareHubBC's reasonable control.

Users are responsible for maintaining accurate contact information and should check the Platform directly when awaiting important or time-sensitive information.

Optional communications may be subject to additional consent or opt-out choices as required by applicable law.

Third-Party Services

DaycareHubBC relies on third-party providers to operate certain Platform features.

These may include services for payment processing, hosting, authentication, database infrastructure, email delivery, SMS delivery, maps, security, and spam prevention.

Third-party services may have their own terms and privacy practices.

DaycareHubBC is not responsible for a third-party service to the extent that the service or event is outside our reasonable control, but nothing in this section limits any responsibility that cannot legally be excluded.

Our handling of personal information involving third-party service providers is described in our Privacy Policy.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, DaycareHubBC is provided on an “as available” basis.

We do not guarantee that:

  • every daycare listing, profile, review, job posting, or other item of user-provided information will be complete, accurate, or current;
  • a particular daycare space, job, applicant, or service will be available;
  • the Platform will operate without interruption or error; or
  • use of the Platform will produce a particular result.

DaycareHubBC does not replace independent professional, legal, regulatory, licensing, medical, childcare, employment, or safety advice or verification where such advice or verification is appropriate.

Nothing in these Terms excludes warranties, conditions, guarantees, or other rights that cannot lawfully be excluded under applicable law.

Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Subject to that limitation and to the maximum extent permitted by applicable law, DaycareHubBC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Platform.

This includes, where permitted by law, losses arising from:

  • inability to access the Platform;
  • interruption or failure of Platform services;
  • missed or delayed electronic notifications;
  • inaccurate information submitted by another user;
  • interactions or transactions between Platform users; or
  • decisions made by independent daycare providers, parents, applicants, or employers.

To the maximum extent permitted by applicable law, DaycareHubBC's total aggregate liability arising from or relating to the Services will not exceed the greater of:

  • the amount you paid directly to DaycareHubBC during the 12 months immediately before the event giving rise to the claim; or
  • CAD $100.

This limitation applies only to the extent permitted by applicable law and does not limit any non-waivable rights or remedies available under applicable consumer protection or other laws.

Indemnification

To the extent permitted by applicable law, if you use DaycareHubBC on behalf of a business or organization, you agree that the business or organization is responsible for claims, losses, liabilities, and reasonable costs resulting from its material violation of these Terms, unlawful use of the Platform, or infringement of another person's rights.

Nothing in this section requires an individual consumer to indemnify DaycareHubBC where doing so would be prohibited or unenforceable under applicable law.

Privacy

Our collection, use, disclosure, retention, and protection of personal information is described in the DaycareHubBC Privacy Policy.

The Privacy Policy should be read together with these Terms.

Where consent to a particular collection, use, or disclosure of personal information is required by law, DaycareHubBC will obtain that consent as described in the Privacy Policy or through the relevant part of the Platform.

Changes to DaycareHubBC

DaycareHubBC may develop, modify, replace, or discontinue features as the Platform evolves.

We may make changes for reasons including:

  • improving the Platform;
  • responding to user feedback;
  • introducing new features;
  • maintaining security;
  • complying with legal requirements; or
  • changing how a particular service is offered.

Where reasonably appropriate, we will provide advance notice of a material change that significantly affects an existing paid service.

Changes to These Terms

We may update these Terms from time to time.

When we update them, we will change the “Last updated” date at the top of this page.

If we make material changes, we will provide additional notice where reasonably appropriate or where required by applicable law.

Your continued use of DaycareHubBC after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

If applicable law requires another form of consent to a particular change, we will obtain it.

Governing Law

Subject to any rights available under applicable consumer protection or other mandatory laws, these Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia.

Any court proceeding relating to these Terms may be brought before a court of competent jurisdiction in British Columbia, unless applicable law provides otherwise.

Nothing in these Terms limits a right or remedy that cannot legally be waived.

Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.

No Waiver

If DaycareHubBC does not immediately enforce a provision of these Terms, that does not mean that we waive our right to enforce it later.

A waiver of one provision or violation does not automatically waive any other provision or future violation.

Entire Agreement

These Terms, together with the Privacy Policy and any additional terms that expressly apply to a particular paid service or feature, form the agreement between you and DaycareHubBC regarding use of the Platform.

Nothing in this section limits any rights that cannot legally be waived under applicable law.
